TERMS AND CONDITIONS OF USE

These Terms and Conditions apply to any purchase of goods and services by You (the Customer or You) from 3D Printing Forge Ltd (the Supplier or us or we) a company registered in England and Wales under number 14277976 whose registered office is at Unit 2L, Fargo Village, Far Gosford Street, Coventry, CV1 5ED.

 

By using the 3D Printing Forge website and service, You acknowledge to have read understood and agree to be bound by these “Terms and Conditions” and to comply with all applicable laws and regulations. If You do not agree to these Terms and Conditions, You should not use the 3D Printing Forge Ltd services and website.

 

We reserve the right to change and update these Terms and Conditions at any time without prior notice. This will be done by posting the updated Terms and Conditions on the website on the “Terms and Conditions” page. Your continued use of the website and our services after the Terms and Conditions have been updated on the website will constitute as Your agreement.

1. Definitions

Customer means the organisation or person who purchases goods and services from the Supplier;

Contract means the legally binding agreement between You and us for the Supply of the Goods or Services;

Goods mean any goods that we supply to You with the Services, of the number and description as set out in the Order;

Order means the Customer’s order for the Services from the Supplier as submitted following the step by step process set out on the Website;

Privacy Policy means the terms which set out how we will deal with confidential and personal information received from You via the Website, email or other method of communication;

Services means the services advertised on the Website, including any Goods, of the number and description set out in the Order;

Supplier means 3D Printing Forge Ltd;

Website means our website 3DPrintingForge.co.uk, on which the Services are advertised;

 

2. General
  1. In the event of a conflict between provisions contained in the Order and these Terms and Conditions, the Terms and Conditions will prevail. No addition, alteration or substitution of these Terms and Conditions will bind 3D Printing Forge Ltd, even if included within an Order, unless explicitly accepted in writing by 3D Printing Forge Ltd, and no pre-printed terms within an Order, will bind 3D Printing Forge Ltd. All such nonbinding terms are hereby rejected by both parties.

  2. When these Terms and Conditions are used in a situation in which You are a consumer and not a professional Customer, some terms and conditions will not apply to You. In this case these Terms and Conditions are applicable to the extent permitted by applicable consumer law. Your rights under these laws are not affected or limited by these Terms and Conditions. Because Your Orders are made to order, no right (statutory or otherwise) of withdrawal or cancellation applies.

 

3. Use of the website

Any info provided on 3D Printing Forge Ltd. website (3Dprintingforge.co.uk) is subject to change. We reserve the right to change our services or advise provided on our website without prior notice. Information provided on Our website is provided as advise only (eg. Materials info, design guidance etc) to give You an brief overview of different options and considerations. 3D Printing Forge Ltd. shall not be held liable for any issues arising from the use of this info.

 

4. 3D printing service
 
4.1 Ordering process

To obtain a quote and order 3D printed component(s) You can use Our online ordering tool, contact form on our website, email us directly using the email address on Contact Us page.

To provide You a quote we require the following information: Your email address, 3D model, part quantity, printing process, material, colour, layer height/quality, infill, delivery address. Occasionally it may be necessary for us to ask further information. We may do so using email address provided by You during the ordering process.

If You are ordering parts using our instant ordering tool, this information will be asked automatically. If You are using our contact form or email, we may have to contact You directly if any of the above information is missing in the order for us to provide You a quote.

Our instant ordering tool only accepts stl files. If You do not have a stl file of Your model, You can contact us and send us 3mf or step files. We may be also able to work with other 3D CAD model formats, but generally it is faster and easier if You provide us one of the file formats specified. In case You have multiple components that require printing send them as separate files and not as multi object files.

Unless You specify custom scaling for a model, we will quote and print it at 100% scale as per the model file.

Unless specified otherwise by You, we will print components in orientation we judge to be best for the printing process. If You require a specific print orientation for part performance or otherwise You need to provide us the details at the time of providing us the 3D models.

If You are using our instant ordering tool You can place and pay for Your order immediately. Once the payment is confirmed Your order will be added to our print queue.

If You use our contact form or email, we will send You an electronic quote. If You want to proceed with the order, You can accept the quote. Quotes are valid for 14 calendar days from the date of issue. Once You have accepted the quote, we will then email You an invoice with a payment link and details. Once Your payment has been confirmed we will add Your order to the print queue.

Once Your order has been completed it will be sent to the delivery address provided by You.

 
4.2 Prices

3D Printing Forge Ltd reserves the right to change its prices without prior notice.

Should an error in pricing occur, we are not bound by our offer and may cancel the order.

 
4.3 Payment

Payment should be made either using our instant ordering tool, payment link on electronic invoice or by bank transfer.

Your components will be added to our printing queue once payment has been confirmed. Lead time for order completion starts from when the payment was made and not from when the quote or invoice was issued. If the payment was made after 4pm, the lead time will start from next working day.

For large orders alternative payment schedules can be considered. Please contact us directly to discuss alternative payment schedules.

4.4 Order Confirmation and Acceptance

Once Your payment has been processed, we will send You an order confirmation to the email address provided to us during the ordering process. The order confirmation will be effective from the date when it was sent to You.

Given the custom nature of our services all orders will go through a manual review. If Your order passes the review, we will then send You an Order acceptance email and the invoice for the order.

If there are any issues accepting and confirming the order we will notify You by email.

4.5 Unacceptable orders, cancellations of orders by us

Occasionally there may be technical or other reasons why we cannot accept or must cancel Your order during the entire ordering process, even after our acceptance of Your order. For example (but not limited to) this can be due to issues with the provided CAD models, design suitability for the specified manufacturing process, the delivery destination or other.

Any functioning weapon or parts from weapons will not be printed. Any components for weapons concealed or disguised as other parts in order to bypass this rule will remain the responsibility of the person(s) who upload the files and they will be held liable for any legal actions as a result of the prints.

4.6 Order Amendments

After the acceptance and payment of the order, there can be no changes to the files being printed or printing processes or materials used.

For larger orders changes to the quantities can be considered, however this is not guaranteed.

4.7 Lead Times

Lead times are only estimates and in no way guaranteed. This is due to factors such as machine failures, power cuts and acts of God which are not predictable.

Our instant ordering tool provides a lead time for small orders. Orders for very large parts or larger quantities lead times can be longer. If You are using our instant ordering tool, we reserve the right to adjust the lead time for Your order – this will be done as part of our Order acceptance process.

Our lead times are dictated by the printing process, material and total printing time.

4.8 Shipping

Your order will be sent to the shipping address specified by You during the ordering process. We are not liable for incorrect shipping addresses, and no refunds are given if incorrect shipping addresses are given. If there is a change to the delivery address, please contact us immediately and we can change it provided that the order has not been shipped.

All orders are sent out in protected boxes and by the delivery option chosen by You during the ordering process.

Pick-up of the order may be possible; however, this has to be agreed with us prior to ordering.

4.9 Order Cancellation and Returns

Given the highly custom nature of our service, You cannot cancel Your order after it goes into production.

Depending on order specifics, You may be eligible for partial refund only. For example (but not limited to) if we had to procure materials specific to Your order, we would not be able to provide a full refund even if we have not started manufacturing yet.

4.10 Part Accuracy

3D Printing Forge Ltd cannot guarantee any part to any degree of accuracy. This is due to the nature of the printing processes where distortions are not always predictable.

Majority of parts are within +/- 0.3mm of the original dimension or 0.3% of the dimension, whichever is greater. No reprints will be offered if a part falls within the stated tolerances. If a part does fall outside of these tolerances, it is at the discretion of 3D Printing Forge Ltd. as to whether the part will be reprinted.

Any features that have a thickness less than 1.2mm will not be guaranteed to any level of accuracy.

 

4.11 Minimum Guaranteed Thickness

Parts are guaranteed with a minimum wall thickness of 1.2 mm. We will print things thinner than 1.2 mm, but it is at Your own risk. If the parts break in our hands, Your hands, during delivery, or lost during the cleaning process, it will not be covered or reprinted for free. We carry out checks before commencing prints – however, thin walls and small features can sometimes be missed. In these instances we are not held responsible if the features are missed and printed anyway, resulting in a failed or broken part.

4.12 Quality

3D Printing Forge is responsible for ensuring that the parts are defect free in terms of manufacturing process. This includes (but is not limited to) under extrusion, poor layer adhesion and excessive localised warping.

However, like any other manufacturing process, 3D printing processes do have their downsides and for this reason there are number of characteristics that do not qualify as defects. These include, but are not limited to layer lines, surface imperfections from support structures, bridging, delamination  between layers and overhang imperfections.

4.13 Fit for purpose

It is the responsibility of You as the Customer to ensure that Your design is fit for purpose and that Your parts and/or product meet any regulatory requirements if applicable. 3D Printing Forge Ltd does not guarantee or take responsibility of any Customer parts being fit for purpose.

It is Your responsibility to choose the suitable manufacturing process, material and design components according to the limitations of these factors. It is also Your responsibility to ensure that appropriate verification and validation is carried out to ensure parts are fit for purpose.

We are not responsible for Your design should it not be fit for purpose. This includes factors such as part geometry, selected printing process, chosen material and specified print settings supplied during the ordering process.

We may provide advice if requested, but we cannot guarantee the printed part will be fit for purpose. It is the responsibility of the Customer to ensure their design is fit for purpose.

This excludes scenarios where there are substantial dimensional differences between the printed components and the supplied CAD model files.

 

4.14 Post Processing

Our print service includes removal of support structures for FDM/FFF and resin prints. It also includes curing of resin prints.

If Your part requires supports for printing, then it is expected that surface imperfections will be present at the location of the supports. This is because the supports will physically attach to the part as well as removal of the support may in some instances lead to minor part damage.

Other post processing services may be offered at extra cost.

4.15 Use of 3rd Party Companies

In certain circumstances, it may be necessary for 3D Printing Forge to use a 3rd party company to complete orders or certain aspects of a job e.g. post processing. 3D Printing Forge Ltd. cannot be held responsible if there are any problems or longer lead times caused by using this 3rd party. Although we strive to complete jobs within the lead times stated, we cannot always guarantee these.

4.16 Delays to order

In some rare circumstances there may be a delay to Your order, in these circumstances there may be a variety of reasons which include, but are not limited to; failure of Quality Control due to discolouration or damage, machine failure, power cuts and ‘Acts of God’. If one or more of these issues do arise, we will re-print the affected files, but this may cause a delay to the order. As these problems are always unforeseen, 3D Printing Forge Ltd. accepts no responsibility for missed deadlines and is under no obligation to offer a refund or any form of compensation.

4.17 Order Refunding or reprinting

In some instances orders must be reprinted or require refunding due to issues with the printed parts, all items in question must be shipped back to 3D Printing Forge Ltd. Costs incurred are the responsibility of the client returning the package.

3D Printing Forge Ltd. will not begin the reprinting or refund process of the order until the parts have been received and assessed for damage or any other anomalies. For this reason we recommend that orders are returned only via a tracked and recorded delivery service so that both parties have a record of the order being returned.

If 3D Printing Forge Ltd. believes that the parts originally supplied conform to our Terms and Conditions, we will declare the order fit for purpose and will provide an explanation on the reasons why. No refund or reprint will be organised in this instance. Cost of redelivery will be the responsibility of the client.

In case there is an issue with the part quality that we consider to be beyond what is to be expected with the chosen manufacturing method we will either issue a refund or reprint the part. Any refunds or reprints that are agreed upon will complete within 10 working days unless otherwise stated.

 

4.18 Issues and Complaints

Any issues that arise from any order that is placed with us, must be made within 30 days of the order being received as per the tracking number provided at the time of dispatch. Failing to do so will waive all rights to any reprints or refunds. 3D Printing Forge Ltd. advise that You check all parts of Your order when they arrive for any faults or issues regarding its service.

 

4.19 Warranty

We provide NO warranty on any parts and do not insure against design in any way.

Any misunderstandings around the suitability of 3D printing processes for Your specific design are not grounds for a refund in any case. This includes (but is not limited to) mechanical properties, surface finish and chemical properties.

It is Your responsibility to understand the limitations of 3D printing technologies as they apply to Your part in its use. 3D Printing Forge shall not be liable for designs that we are independent from.

Any advice provided by us is not a guarantee, and it is the responsibility of the Customer to carry out suitable verification and validation.

 

5.Design, CAD modelling service and consultancy

 

5.1 Quoting and Ordering

To get a quote for our services You can use our contact form or email provided on the website. We will then ask for further information to allow us to put together a quote.

It is the responsibility of the Customer to share all the relevant information (including but not limited to specifications, requirements, models, data etc.) with us. 3D Printing Forge shall reserve the right to charge for any additional time or material needed that arises from inaccurate, incomplete, missing, or new information.

Any lead times provided in the quote are approximate and are not guaranteed.  All lead times are provided assuming the scope is the Customer can provide info, respond to questions, review and approve documents and designs in the timely manner.

Depending on the project we can provide a quote for the complete project as a single cost, or charge based on time and materials spent on an ongoing basis.

 

5.2 Payment

For projects quoted as a single cost, 40% of the balance shall be paid before work commences. On completion of the project the Customer shall pay the outstanding sum within 30 calendar days.

For projects charged based on hours and materials spent, we shall issue an invoice to You every two weeks. These invoices shall be paid within 30 calendar days.

If the project requires substantial material purchase on our part, then we reserve the right to invoice for this separately.

Alternative payment schedules can be considered based on specific projects.

 

5.3 Customer obligations

It is the responsibility of the Customer to provide 3D Printing Forge all the information required to carry out the design work in a timely manner. We are not liable for any mistakes or issues arising from missing or inaccurate information. It is the responsibility of the Customer to supply all the relevant information, models, physical parts, models etc. and to ensure they are accurate.

The client is responsible for reviewing and approving all specifications, requirements, concepts, drawings, proofs and models. It is the responsibility of the client to ensure that all documents and other data is correct before approving it. Once the Customer has given their approval, changes may not be possible without considerable rework or additional work. Any changes will delay the project and we reserve the right to charge extra for additional time and materials.

If the Customer is not satisfied with the end product, 3D Printing Forge Ltd. shall not be liable as long as the final product meets the specifications previously approved by the Customer.

Any claims for damages or missing goods must be made within 7 calendar days of receiving the goods.

The Customer is responsible for the product functionality and ensuring it is fit for purpose. The Customer is responsible for identifying, specifying, and approving any validation and testing activities. 3D Printing Forge Ltd. can carry out validation activities and tests as specified and agreed with the Customer, but the Customer is responsible for approval of the results.

6. Retention of Title

Notwithstanding delivery and passing of risk, ownership of the Goods shall only pass to the Customer once the Supplier has been paid in full for the goods.

 

7. Intellectual Property and NDAs

If it is required by You, we can sign an NDA. This can be done at Your request for 3D printing services as well as our Design and Modelling service.

We reserve the right to contact You to request if images of Your parts or models can be used for marketing purposes on our website or social media accounts.

By using our service, You confirm that You have the full right and authority to share the CAD models and any other data with us for the intended purposes. This applies to both models and data created by You as well as any data that You share but have not created Yourself. Should any data shared by You with us turn out to infringe and/or be in violation of any law, You will defend 3D Printing Forge against 3rd party claims and will be held liable for all damages (direct and indirect) and costs incurred by 3D Printing Forge with respect to such claims.

All Intellectual Property we generate for Your project shall be assigned to You upon receipt of all sums owed to us.

8. Limitation of Liability

In no event shall 3D Printing Forge Ltd., it’s directors, employees, suppliers, or agents be liable to the Customer or any third party for any direct, indirect, consequential, exemplary, incidental, special or punitive damages, including loss of income, loss of opportunity, loss of profits, loss of data, or other intangibles, damage to reputation or to goodwill arising from Your use of our website and services. This still applies even where such a loss was reasonably foreseeable, or the Supplier had been made aware of the possibility of the Customer incurring such a loss.

 

9. Indemnity

You shall indemnify, defend and hold harmless 3D Printing Forge, it’s agents, directors, officers, employees, consultants and partners and their employees against all claims, costs and expenses which the Supplier may incur and which arise, directly or indirectly, from the Customer’s breach of any of its obligations under this Agreement, including any claims brought against 3D Printing Forge alleging that any goods and/or services provided by us infringes a patent, copyright or trade secret or other similar right of a third party.

10.Waiver
​

If either party is unable to or fails to enforce at any time one or more of these Terms and Conditions, it shall not be a waiver of them or of the right at any time subsequently to enforce all Terms and Conditions.

 

11.Termination

3D Printing Forge reserves the right to terminate this Agreement by notice in writing to the Customer if:

  1. Customer commits a materials breach of the contract, and they fail to remedy the breach within 14 calendar days of the written notice; or

  2. Customer passes a resolution for winding up (other than for the purpose of solvent amalgamation or reconstruction), or a court of competent jurisdiction makes an order to that effect; or

  3. Customer ceases or threatens to cease to carry on their business; or

  4. Customer breaches these Terms and Conditions

12. Changes to the website, our Terms and Conditions and services

We reserve the right to make changes to the website, these Terms and Conditions and our services without notice. The changes will take effect when changes are posted on our website (3dprintingforge.co.uk).  These changes do not have an effect on orders placed before the changes are posted.
